Terms of service

These terms of service (“Terms”) apply to the Kondora platform, including websites we build and host, the content editor (CMS), forms and the Leads CRM (together, the “Service”). By using the Service or signing an order with Kondora (“Kondora”, “we”, “us”), you (“you”, “Customer”) agree to these Terms. If you accept on behalf of an organisation, you confirm you may bind it.

1. The Service

Kondora builds and hosts lead-generating websites and provides tools to edit content, manage forms and work with leads. The features, pages, prices and deliverables for your account are those in your order, quote or plan. Agencies may resell the Service to their own clients under a separate partner agreement.

2. Accounts and access

You are responsible for the accounts you create or invite, for keeping sign-in details secure, and for the actions taken with your accounts. Tell us promptly at hello@kondora.ai if you suspect unauthorised access. We may suspend access to protect the Service or other users.

3. Your content and data

You keep ownership of your content, your domain and the leads collected by your websites. You give us the rights needed to host, copy, display and process them only to provide the Service. You are responsible for your content, for the claims on your website, and for having a lawful basis and any consents needed to collect and use leads, including under marketing, privacy and telephone rules that apply to you. For personal information we process for you, we act on your instructions as described in our privacy policy.

4. Acceptable use

You must not use the Service to break the law; to send spam or unlawful marketing; to publish content that is fraudulent, infringing, defamatory or harmful; to collect data without permission; to attempt to access accounts or systems you are not allowed to access; or to disrupt, overload or reverse engineer the Service.

5. Fees and payment

Fees are set out in your order or plan. Builds are billed as agreed, and monthly plans are billed in advance. Plans run month to month and either party may cancel with 30 days’ notice. Unless stated otherwise, prices are in US dollars and exclude taxes. We may suspend the Service for overdue amounts after giving notice.

6. Third-party services

The Service relies on providers such as Amazon Web Services, Google and GitHub, and can connect to tools you choose, such as Zapier or your CRM. Your use of third-party tools is also governed by their terms, and we are not responsible for them.

7. Availability and changes

We work to keep the Service available and backed up, but it may occasionally be interrupted for maintenance or reasons beyond our control. We may improve and change the Service; we will not remove a core feature you pay for without reasonable notice.

8. Confidentiality

Each party will protect the other’s non-public information and use it only for the purposes of these Terms.

9. Warranties

We will provide the Service with reasonable skill and care. Otherwise, to the extent the law allows, the Service is provided “as is”, without other warranties, express or implied.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and each party’s total liability under these Terms is limited to the fees you paid in the 12 months before the claim. These limits do not apply to your payment obligations or to liability that cannot be limited by law.

11. Indemnity

You will defend and compensate Kondora for claims arising from your content, your use of leads, or your breach of these Terms.

12. Ending the Service

You may cancel as described in section 5. We may end or suspend the Service if you seriously breach these Terms and do not fix the breach after notice. When the Service ends, we will make your leads available as a CSV file and your content and media files available for download for 30 days, after which we may delete them, except for backups kept for up to 90 days.

13. Changes to these Terms

We may update these Terms. We will change the date at the top and notify account holders of significant changes. Continuing to use the Service after a change means you accept it.

14. Governing law

These Terms are governed by the law stated in your order. If none is stated, they are governed by the law of the place where Kondora is established, and disputes will be handled by its courts.
